Treas. Reg. § 301.6212-1: Deficiency-Notice Procedure

The regulation under section 6212 addresses issuance of deficiency notices and joint-return notice rules.

Treasury Regulation section 301.6212-1 should be read alongside sections 6212 and 6213 when evaluating a statutory notice of deficiency and the resulting Tax Court route.

What the authority does

The regulation addresses when the district director or another authorized official may send a notice of deficiency and includes rules concerning a joint income-tax return. The statutory mailing and petition provisions remain central.

Why it matters in a tax controversy

The full notice and envelope should be preserved. The taxpayer's address history, powers of attorney, joint or separate status, prior examination correspondence, and stated petition deadline should be assembled before relying on a procedural objection.

What it does not answer by itself

The regulation does not resolve the amount of the deficiency, compute the petition deadline in every circumstance, or substitute for Tax Court filing rules and controlling cases.
