KRS 134.580: Kentucky Tax Refund Claims

KRS 134.580 governs claims for refunds of specified Kentucky taxes and contains timing, claim, interest, and procedure provisions.

KRS 134.580 is a central statute when a taxpayer seeks repayment of Kentucky tax believed to have been overpaid. The claim procedure differs from a prepayment protest of a proposed or unpaid assessment.

What the authority does

The statute addresses refunds and credits for covered taxes, the period and manner for making claims, Department action, interest, offsets, and related limits. The current text and the tax-specific chapter must be reviewed for the particular payment and period.

Why it matters in a tax controversy

A useful claim identifies the tax type, periods, payments, amount requested, legal ground, factual basis, and supporting schedules. Payment dates, return dates, amended returns, federal changes, credits, and prior Department correspondence can affect both timeliness and amount.

What it does not answer by itself

An account credit or amended return is not necessarily a sufficient administrative refund claim for every purpose. A denied claim also triggers a separate appeal analysis under the current ruling and KRS 49.220.
